Legal Services Act: Further amendments to SRA rules

Legal Services Act: New forms of practice and regulation
Consultation paper 11

The deadline for submission of responses to consultation paper 11 on the Legal Services Act was 10 November 2008.

A paper dealing with the changes to rules and regulations addressed in this consultation was considered by the SRA Board on 22 January 2009; the changes came into force on 31 March 2009.

The information that appears below is for reference purposes only.

When we published changes to the Code of Conduct to enable legal disciplinary practices (LDPs), we indicated that some of the rules might need to be changed in the light of a government proposal to amend the new section 9A of the Administration of Justice Act 1985, which is the section that defines a legal services body and allows LDPs with up to 25 per cent non-lawyermanagers. The reason for amending the section is to remove an unnecessary restriction on the number of tiers of corporate membership that a recognised body may have.

The Ministry of Justice has now published the proposed amendment order, and the SRA has drafted consequential amendments to rule 14 of the Code of Conduct and related rules. The opportunity has been taken to correct errors, omissions and ambiguities, mainly of a technical nature.

You can download the SRA Board paper (approved in principle on 16 October 2008) explaining the changes and attaching the draft amendment rules.
