This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that :-
- Between 17 July 2017 and 28 September 2022, he requested and received money from clients for legal services, by bank transfer into his personal bank account and in cash, which he failed to pay into a client account or return to the client;
- Between 17 July 2017 and 28 September 2022, he accepted instructions and funds from clients for legal work that was never undertaken by him;
- Between 13 April 2021 and 17 July 2021, failed to disclose the existence of clients he had been instructed to act for to Julia & Rana Solicitors and failed to maintain case records for those clients when he was under a contractual duty to do so, dishonestly intending by those failures to make a gain for himself or cause a loss to Julia & Rana Solicitors.
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.

Matthew Goldborough’s practising certificate for 2021/2022 is subject to the following conditions:
- Mr Goldborough shall not act as a manager or owner of any authorised body.
- Subject to condition 1), Mr Goldborough may act as a solicitor, only as an employee where the role has first been approved by us.
- Mr Goldborough does not hold or receive client money, or act as a signatory to any client or office account or have the power to authorise transfers from any client or office account.
Conditions 1) and 3) are effective immediately. Condition 2) is effective from 5 February 2022.

Reasons/basis
The above conditions are necessary in the public interest and reasonable and proportionate having regard to the purposes set out in regulation 7 of the SRA Authorisation of Individuals Regulations and the regulatory objectives and principles governing regulatory activities as contained in section 28 of the Legal Services Act 2007.
